Lawyers acting for Doug Polk and his partners have attempted to silence PLO coach Fernando “JNandez87” Habegger, despite Polk’s Upswing Poker crew having already lost one lawsuit costing them over $150,000.

Lawyers for Polk have claimed that Habegger is still bound by a confidentiality clause, even after Polk repeatedly took to social media to harangue the Swiss PLO expert during their falling out.
Washing Dirty Laundry in Public
Doug Polk and Habegger have been embroiled in a public battle of words since the latter left Polk’s Upswing Poker in 2018, unhappy with what he was being paid for his coaching work among other issues.
That departure led Polk to launch a social media campaign against Habegger, stating publicly: “JNandez plans to steal our customers and use that to begin his own site,” and claiming that Habegger had failed to pay an old woman who had knitted scarves with the JNandez logo.

This was followed by a lawsuit claiming Habegger had breached his contract, with Charlie Carrel recently divulging details of the case.

Habegger’s counterclaim for defamation was thrown out by the judge, but he was awarded him contract damages of $17,000, $110k+ attorney’s fees, and $12k in litigation costs – a win in anyone’s book.
With Doug Polk unusually silent on the matter, Habegger decided to release the full details of his win, and the “smear campaign” he’d been subjected to by Polk.
As the opening tweet shops, lawyers acting for Polk and his partners at Upswing weren’t happy at this public fightback, which included Habegger appearing on Matt Berkey’s Only Friends podcast.
Spinning Lies and Gaslighting
Habegger was far from ready to be quiet about the long-running situation, explaining in no uncertain terms that he’d won the lawsuit…
– My contract counterclaim was granted. You breached the agreement by deciding to withhold my owed payment.
– I never said you stole. When did you note you owed me 17k instead of 1,3k?
– I stated everything else correctly, stop trying to gaslight people or spin lies.
