JNandez has taken to Twitter to reveal shocking details of his court case against Upswing Poker. Five years ago, the high-stakes PLO crusher famously tore up his contract with the coaching site, using an option which was given to all coaches.
Doug Polk publicly harangued JNandez even though the option to quit was perfectly legal. Typically, the poker community was split with many social media accounts supporting their favourite player rather than being objective.

JNandez makes it clear, using screen shots, that the exit clause in his contract was not a “loophole,” as stated by Doug Polk, but a standard clause inserted in other coach’s contracts too.

He added that he had no part in the writing of the contract.
JNandez Awarded $150,216 in Damages
When the court case was concluded, the judge ruled in favour of JNandez and awarded him $150,216 in damages.
The defamation claim was thrown out, surprisingly, but on every other part JNandez found himself a winner.
My breach of contract counterclaim was granted with contract damages, and I was awarded partial attorney’s fees and costs. My defamation claim was denied. In total, Upswing had to pay me $150,216.

JNandez’s Twitter thread then reveals a surprising part of Doug Polk’s claim against him. Upswing Poker had actually tried to claim that the “Play & Explain” video format was their intellectual property.
JNandez had no problem batting this issue aside by showing that he had recorded several videos of this type as far back as 2015.
Upswing Poker also tried to force JNandez to take down his YouTube videos, claiming that they qualified as work for them.
And it doesn’t stop there. After leaving Upswing Poker, JNandez produced his own course which Upswing then tried to claim as their own due to similarities.
This was followed up by a spurious claim on JNandez’s personal Excel spreadsheet for pre-flop ranges.
